Compliance

For Simplicity team members

The American Council of Life Insurers filed an amicus brief in U.S. District Court in support of a lawsuit seeking to overturn the Department of Labor exemption that established a fiduciary duty for rollover recommendations.  The lawsuit, filed in February by Federation of Americans for Consumer Choice, which represents annuity and life insurance firms, along with several advisory firms and advisers for annuities, centers around a 2020 Labor Department prohibited-transaction exemption.  The ACLI was the previous plaintiff of the successful challenge in 2018 of the previous DOL rule proposal that ended up being vacated.  The Department of Labor is expected to respond to the brief in the upcoming week.  Read more here.

Simplicity’s Compliance department will continue to monitor the situation and provide updates and guidance.
